Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the FormMaps website (formmaps.com) and platform (the “Service”), operated by TIMS International (“FormMaps,” “we,” “us”). By using the Service, you agree to these Terms. If you are accepting on behalf of a school, district, or other organization, you represent that you are authorized to bind it, and “you” includes that organization. If you do not agree, do not use the Service.

Eligibility & who may use FormMaps

The Service is intended for use by schools and the students, staff, and families they authorize, and by individuals permitted under applicable law. Students who are minors may use the Service only under a school’s authorization or with verifiable parental consent, as described in our Privacy Policy. We do not knowingly allow direct account creation by children below the age of consent without such authorization.

Accounts

You are responsible for the accuracy of your information and for safeguarding your credentials and all activity under your account. Schools are responsible for the accounts they provision to staff and students and for their users’ compliance with these Terms. Notify us promptly of any unauthorized use.

Schools, students & data roles

When the Service is provided to a school, the school directs the processing of its students’ data and is the data controller; we act as its processor / school official. The relationship between us and a school is also governed by the applicable order form, subscription agreement, and any data processing addendum, which control in the event of a conflict with these Terms for that school.

Acceptable use

• Use FormMaps only for lawful, educational purposes.
• Do not attempt to disrupt, probe, or gain unauthorized access to the Service or its data.
• Do not reverse-engineer, decompile, scrape, or resell the Service except as permitted by law.
• Do not upload unlawful, harmful, or infringing content, or impersonate others.
• Do not use the Service to build a competing product or to train machine-learning models on our content without permission.

Assessments & guidance — no guarantees

FormMaps provides data-informed guidance to support — not replace — professional counseling and individual judgment. Career, major, and college matches are recommendations, not guarantees of any outcome, admission, score, or result. Decisions remain the responsibility of the student, family, and school.

Intellectual property & your content

FormMaps and its content, software, and assessments are owned by TIMS International and its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service per your agreement. Your data remains yours. If you send us feedback or suggestions, you grant us a non-exclusive, royalty-free right to use them to improve the Service.

Fees, subscriptions & refunds

School and district subscriptions are governed by a separate order or agreement, including pricing, term, and renewal. Individual plans, where offered, are described at sign-up; fees are billed in advance and, unless stated otherwise or required by law, are non-refundable. Where subscriptions renew automatically, we will disclose this at purchase and you may cancel as described in your plan before the renewal date.

Third-party services

The Service may interoperate with or link to third-party services (for example, a demo scheduler or email provider). We are not responsible for third-party services, and your use of them is governed by their terms.

Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, FormMaps will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law (for example, for gross negligence, willful misconduct, or personal injury where applicable).

Indemnification

To the extent permitted by law, you agree to defend and indemnify FormMaps against third-party claims arising from your misuse of the Service or your violation of these Terms or applicable law, except to the extent caused by us.

Term & termination

Either party may terminate as set out in the applicable agreement, and we may suspend or terminate access for material breach, unlawful use, or risk to the Service or others. On termination we will return or delete data as described in our Privacy Policy and any data agreement. Sections that by their nature should survive (for example, intellectual property, disclaimers, liability, and indemnification) will survive.

Governing law & disputes

The governing law and venue are set in your order or, absent one, the laws of the jurisdiction of TIMS International’s principal place of business, without regard to conflict-of-laws rules. The parties will first attempt to resolve disputes informally by contacting us at hello@formmaps.com. Mandatory consumer protections in your country of residence still apply.

Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, such as outages, natural events, or acts of government.

General

If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with any applicable order, subscription agreement, and data addendum, are the entire agreement between you and us regarding the Service.

Changes & contact

We may update these Terms and will post the revised date here; material changes will be communicated where required. Continued use after changes means you accept them. Questions: hello@formmaps.com.
